22-64 As discussed in the section on settlement, the parties may request that the Court confirms by
way of a decision the terms of an arbitral award by consent. 74
22-65 In relation to arbitral awards on the merits, the situation in relation to enforcement should be
familiar from other types of arbitration, such as arbitration under the WIPO arbitration rules. 75
As all Contracting Member States are signatories to the 1958 New York Convention on the
Recognition and Enforcement of Foreign Arbitral Awards, then arbitral awards by panels
operating under the auspices of the Centre will be enforceable under this Convention, subject
only to the limited exceptions set out in Article V of the Convention. Therefore, arbitral awards
by panels operating under the auspices of the Centre will, as with awards by other arbitral
tribunals, have the benefit, compared to decisions of the Court, of being directly enforceable
outside of the Contracting Member States.
